General Terms & Conditions

1.    Scope

The following General Terms and Conditions (hereinafter "GTC") of Elco AG (hereinafter "Elco AG" or "the Seller") shall apply to all contracts, deliveries and other services and offers the customer enters into with the Seller through the Seller?s online store stickerella.com. By accepting an offer or placing an order, the customer agrees to these terms and conditions.

2.    Conclusion of the contract

Elco AG offers are non-binding. The purchase agreement for your selected item(s) will be concluded once we confirm your order by e-mail.

By accepting an offer or placing an order, the customer explicitly agrees to these GTC.

Small deviations and technical changes to our images or descriptions are possible. Images may not entirely reflect colours or lettering. The respective website shall become invalid once a new version is published.

- Once you have placed and completed an order, it is no longer possible to add to this order.

- Elco AG reserves the right to reject orders on legal, ethical, financial or other grounds, without giving reasons.

 

3.    Prices/delivery costs

All prices quoted are inclusive of Swiss VAT within Switzerland, or German VAT in Germany and other EU countries.

The following delivery costs apply in addition to the prices quoted:

Delivery costs within Switzerland:     CHF 2.50

Delivery costs within the EU:             EUR 8.00

Elco AG expressly reserves the right to change prices at any time and with immediate effect.

 

4.    Payment

Payment may be made by credit card, PayPal (5% commission will be applied), Postfinance or cash prepayment.

 

5.    Delivery/transfer of risk

All orders shall be passed on to the carrier no later than ten days after receipt of payment. Elco AG shall use Swiss Post or one of its partners for delivery.

Delivery may be delayed by force majeure. Force majeure means delays in delivery or failure to perform due directly and exclusively to events caused by external forces which are unforeseeable, unavoidable and occur through no fault of either your own or our own; in particular electrocution, power cuts, terrorist attacks or threats, war, invasion, fire, explosions, storms, floods, earthquakes, epidemics and other natural disasters. Force majeure further includes the inability to use transport routes maintained by both public and private service providers (ship, aircraft, motor vehicles, railways). We shall notify you immediately of the beginning and end of such circumstances.

Once the goods are handed over to the postal service, the risk of accidental loss passes to the buyer. From the moment the goods are handed over to the postal service, Elco AG is therefore not liable for any delay in delivery, damage or lost consignments.

On delivery to European Union countries, the risk of accidental loss and accidental deterioration of the goods sold is transferred, in the case of mail-order purchases, when the goods are handed over to the buyer or a designated recipient.

 

6.    Retention of title

The goods shall remain the property of the Seller until paid for in full.

 

7.    Right of return

For purchases made through the online store, Elco AG grants a right of return of 14 days, which shall begin upon receipt of the goods. To exercise this right of return, the goods must be handed to the postal service for return within this period. Late returns will not be accepted.

Goods must be returned unused and undamaged, otherwise the claim to a return shall be forfeited.

Generally, no right of return is granted in respect of goods:

- which are not ready-made, and for the production of which the consumer is required to make an individual selection or specification, or which are clearly customised to the individual requirements of the consumer;

- if the customer selected the wrong text or icon for the product or if our instructions were not followed.

The customer shall pay the cost of the return.

For goods which have been delivered incorrectly or are damaged or defective, you have additional rights (see point 8: Material warranty), which are not affected by the right of return.

 

8.    Material warranty

In terms of the material warranty, the statutory provisions shall apply. Rather than requesting that the contract be cancelled or a reduction in price, you instead authorise Elco AG to replace defective products immediately with products free of defects (authorisation for replacement delivery).

9.    Liability

Liability and claims for damages are excluded against both the Seller and the Seller?s employees to the extent permitted by law.

Elco AG shall accept no liability for improper or incorrect use of our products. Instructions for use are delivered together with the product. Elco AG shall accept no liability for the up-to-dateness, accuracy or completeness of the Stickerella website and the information and data provided. Nor does it assume any liability for damage to property while ironing on or sticking on Stickerella labels.

 

10. Applicable law and place of jurisdiction

Swiss law shall apply to all legal transactions or other legal affiliations with Elco AG. The UN Convention on Contracts for the International Sale of Goods (CISG) and any other international conventions shall not apply.

For contracts with an objective that cannot be attributed to the professional or commercial activity of the beneficiary (contract with consumers, consumer contracts), this choice of law shall apply only insofar as the protection provided by mandatory provisions of the law of the country in which the consumer is habitually resident is withdrawn.

For disputes between traders, the agreed place of jurisdiction shall be at the headquarters of Elco AG.

In the case of consumer contracts, jurisdiction lies:

- for complaints by the consumer: with the court at the domicile or headquarters of one of the parties;

- for complaints by the supplier: with the court at the domicile of the defendant.

Consumer agreements are agreements concerning services of usual consumption, which are intended for the personal or family needs of the consumer.

 

11. Amendments

Elco AG reserves the right to amend these GTC at any time and without notice.

 

12. Severability clause

Should one or more provisions of these GTC be invalid, this shall not invalidate the rest of the contract. The invalid provision shall be replaced by the relevant statutory provision.
